please respond to Christopher with 150. words I think that there have been instances in which our first amendment rights have been eroding due to the influence on social media companies on our political discourse. The public square is the most important aspect of a republic, as that is how ideas are disseminated throughout society. In modern times, the public square is social media. Apps like Facebook, TikTok, Instagram, and X are the main streams of political discussion, and the fact that the public square has become privatized is a worrying issue. Now, political discourse is at the whim of the opinions of men like Zuckerberg, or Musk, or even the Chinese government. It is incredibly worrying to think of these prospects, as now unelected businessmen can shut the main mode of communication off for a political candidate (see Trump being banned on Instagram/Facebook), and directly interfere with American Democracy.
In regards to other amendments eroding. In regards to the Second Amendment there has been a steady eroding of it going back to the administration of FDR. From the NFA, to the ATF, to the Assault Weapons Ban, to the insane and frankly unconstitutional gun laws in California, to even the calling for of a mandatory buy back by the current Vice President of the United States, the Second Amendment is under attack. The second amendment is clear, the right to keep and bear arms shall not be infringed; the founders didn’t write this amendment so that we could go hunting or even so that we could protect our home in the case of a burglary. The Second Amendment was written so that the citizenry would have the means to fight back against a tyrannical government if need be, and these actions the government has taken has hampered the ability of the citizenry to take such action.
In regards to the Fourth amendment, with the expansion of the surveillance state after 9/11 there have definitely been questions raised as to whether or not the Fourth Amendment has been eroded. While I can’t affirm yes or no I do believe that there is a groundwork for future eroding of it. It would not surprise me in the future if more illegal searches were deemed reasonable by judges and our Fourth Amendment rights become less strong. In regards to the Eighth amendment, I do not see that eroding. Many states under punish in many cases, for example the removal of the death penalty in many cases or the creation of “wobbler” crimes in the state of California
